These Terms of Service (“Terms”) govern access to and use of the website, API, SDKs, dashboard, and MCP server operated by PlugKit, Inc. (“PlugKit”, “we”, “us”, or “our”) (together, the “Services”). By creating an account, connecting a platform, or otherwise using the Services, you agree to these Terms on behalf of yourself and, if applicable, the organization you represent (“you” or “Customer”).
In short: PlugKit is infrastructure that lets developers and their AI agents connect social and messaging accounts and act on them through one API. You're responsible for how you and your end users use the connected platforms; we're responsible for running the infrastructure honestly, securely, and in line with each platform's developer policies. See our Privacy Policy for how we handle data.
You must be at least 18 years old and able to form a binding contract to use the Services. If you use the Services on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms. You are responsible for maintaining the confidentiality of your account credentials and API keys, and for all activity that occurs under your account.
PlugKit provides a unified API and dashboard that let developers connect social and messaging platform accounts (such as Instagram, WhatsApp, and TikTok) through each platform's official authorization flow, and then publish content, read and reply to messages, and receive events for those accounts. We may add, change, or discontinue features of the Services at any time, and we will make reasonable efforts to notify you of material changes that affect your integration.
The Services interoperate with platforms operated by third parties (each a “Connected Platform”), including Meta (Facebook, Instagram, Messenger, Threads, WhatsApp), TikTok, YouTube, X, and others we add over time. Your use of a Connected Platform through PlugKit is additionally governed by that platform's own terms and developer policies, including the Meta Platform Terms and the TikTok Developer Agreement and Terms of Service. You are responsible for complying with those terms, including any content, messaging, and advertising policies. PlugKit is not responsible for a Connected Platform's availability, changes to its API, or decisions it makes about your connected account (including suspension or removal of access).
PlugKit’s YouTube integration is built on YouTube API Services. By connecting a YouTube channel to PlugKit, you agree to be bound by the YouTube Terms of Service, and you acknowledge that Google’s use of information received through those APIs is described in the Google Privacy Policy. Our own handling of Google user data is described in Section 4.1 of our Privacy Policy. You may revoke PlugKit’s access to your Google account at any time at myaccount.google.com/permissions. You remain responsible for ensuring that the content you publish through PlugKit complies with YouTube’s Community Guidelines and copyright policies; PlugKit does not review, endorse, or take responsibility for that content.
You agree not to use the Services to:
We may suspend or terminate access for any account we reasonably believe violates this section, with notice where practicable.
API keys are issued per account and must not be shared outside your organization or embedded in a way that exposes them to end users. We may apply rate limits, quotas, or throttling to protect the stability of the Services and our compliance with Connected Platform requirements. Continued excessive use after notice may result in suspension.
Paid plans are billed in advance or based on usage, as described at checkout or in your order form. Fees are non-refundable except as required by law or as otherwise stated at signup. We may change pricing on notice effective for your next billing cycle. Overdue amounts may result in suspension of the Services.
You retain all rights to content you submit, publish, or transmit through the Services (“Your Content”). You grant PlugKit a limited license to process, transmit, and store Your Content solely to provide the Services. You are solely responsible for Your Content and for having the necessary rights and consents (including from end users) to publish, message, or process it through a Connected Platform. See our Privacy Policy for how we collect, use, and delete data, including Platform Data.
PlugKit and its licensors own all right, title, and interest in the Services, including our software, APIs, documentation, and branding, excluding Your Content. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Services for your internal business purposes or to build products for your customers.
Each party may receive confidential information of the other in connection with the Services (including API keys, non-public product features, and business information). Each party agrees to use the other's confidential information only to perform its obligations and to protect it with reasonable care, not less than the care it uses for its own similar information.
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT A CONNECTED PLATFORM WILL CONTINUE TO BE AVAILABLE OR COMPATIBLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLUGKIT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO PLUGKIT IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold PlugKit harmless from any claims, damages, and expenses (including reasonable legal fees) arising from Your Content, your use of the Services in violation of these Terms, or your violation of a Connected Platform's terms or applicable law.
These Terms remain in effect while you use the Services. You may stop using the Services and close your account at any time. We may suspend or terminate your access for material breach of these Terms, non-payment, or if required by a Connected Platform or law. On termination, your right to use the Services ends, and we will handle your data as described in our Privacy Policy.
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Any dispute arising out of these Terms or the Services will be resolved in the state or federal courts located in Delaware, and each party consents to personal jurisdiction there, except where applicable law requires otherwise.
We may update these Terms from time to time. We will revise the “Last updated” date above and, for material changes, provide additional notice (for example, by email or an in-product notice). Continued use of the Services after an update constitutes acceptance of the revised Terms.
